BollywoodSoundtracks.com - Terms & Conditions

These Terms & Conditions do not affect your statutory rights. Please read these Terms & Conditions carefully prior to placing your order. We will treat each order for goods as an offer by you to purchase goods subject to these Terms & Conditions.

Age Restriction
You must be aged at least 18 to order goods through our Website.

Stock
You are advised to read full product details of goods prior to ordering. All goods that we sell are, to the best of our knowledge, original and brand-new. Goods are subject to availability. If we do not supply the goods for any reason we will not charge you for these goods and we will refund any money already paid for the goods. In such an event, you will receive an e-mail from us informing you of this. However, we will not be responsible for compensating you for any other losses which you may suffer if we do not supply goods.

Costs
The prices displayed on our Website are what you pay; there are no other costs except delivery charges, which vary depending on the type of goods, quantity ordered and delivery destination. All prices remain valid whilst displayed. However, if the price published for goods on our Website is wrong due to an error or omission, we will inform you of the correct price and give you an opportunity to cancel the order. An invoice giving a breakdown of costs will be enclosed with your order.

Online Payment by Credit or Debit Card
We do not offer any credit facilities and orders will not be dispatched unless full payment has been received. We accept payment online via the following Credit / Debit Cards: Visa, MasterCard, Delta, Maestro, JCB and Solo. When paying by Credit / Debit Card, please note that you can input Delivery Address details that are different to the Billing Address. However, the WorldPay Secure Server Page (where Card details are entered), will only accept the order if the Billing Address matches the details held by the Card issuer. Any fraudulent attempts to place orders will be reported to all the relevant authorities and agencies.

Payment by Cheque or Postal Order
To pay by UK cheque or a crossed British Postal Order, please print our online Order Form (after adding goods to the Shopping Basket and selecting the appropriate Delivery Option). The Order Form should then be sent with full payment made payable to 'BollywoodSoundtracks.com', to the address displayed on the Info Page. Goods paid for by cheque or Postal Order will only be dispatched after the payment has cleared, which usually takes about 4 working days. If you wish to make payment by cheque in a foreign currency, there is an additional charge. Please click on the e-mail link on the header to contact us for further details.

Payment by Cash
If you wish to make payment by cash in UK currency, we recommend that you use Royal Mail's Special Delivery service to send us the payment. Cash sent via the ordinary post or by any other method other than Special Delivery will be at the sender's risk and we cannot accept any responsibility should payment go astray in transit.

Order Acceptance
Customers making an online purchase are sent an automated e-mail on completion of their order to confirm that we have received their order details. Please note that this e-mail does not mean that we have accepted your order. We reserve the right to decline any order and refund the payment rather than deliver the goods. The most common circumstances in which we may decline an order are: (1) We were unable obtain authorisation for the payment (2) An item you ordered is out of stock and we are unable procure it (3) There is a pricing error or the product details are inaccurate on the item you ordered (4) You do not meet the eligibility criteria to order from our Website as set out in our Terms & Conditions. We will notify you via e-mail if we decline your order.

Delivery
You must provide us with your correct address, and also notify us of any change of address whilst you are awaiting delivery of any oustanding items. Under the product details of each item in our catalogue, we have provided details of an approximate dispatch time. Where more than one item is ordered, then all items are dispatched when the entire order is ready. If we are unable to send your order within 3 working days after the approximate dispatch time, we will contact you via e-mail to explain what is holding up the shipping.

Delays in the delivery of goods are sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay of delivery of the goods. Based on the advice of the Postal Services, you should allow up 15 working days for your order to arrive. If you are selecting a quicker delivery option, please note that the quicker delivery time applies after an order has been posted and not neccesarily from time you placed your order e.g. if an item is not in stock at the time of ordering, there may be delay in dispatching your order even though you have selected a quicker delivery option. You may therefore wish to contact us for information on availability prior to selecting a quicker delivery option.

You assume responsibility for goods as soon as they are delivered. If you delay accepting a delivery, our responsibility will end on the date the delivery person tried to deliver the goods to you. We are not responsible if an unauthorised person accepts delivery on your behalf. If a parcel is returned to us as undelivered because you did not accept the delivery or because you provided an incorrect delivery address, you would need to contact us (within 6 months) and pay the postage costs again before we can resend. We are not responsible for customs duty imposed, if any, by the officials at the delivery destination. In the event of any charges, they will be borne by you. If we send you incorrect goods, you must return the parcel to us as soon as possible and we will reimbruse your postage costs.

We have to allow at least 10 working days after dispatch before we can make a request to Royal Mail to investigate a missing parcel. We act according to Royal Mail’s advice in respect of any delays/damage or loss and you must also agree to this and accept Royal Mail's decision as final. In the unlikely event of us not dispatching your goods within 28 days, you have the right to contact us and refuse to accept the goods and we will refund any money paid by you for undelivered goods.

Cooling-off Period
A cooling-off period of 7 working days applies during which you may cancel your order. Goods that have already been delivered, may be returned to us within 7 working days providing the plastic shrink-wrap on the CD / DVD has not been opened, but our postage and admin costs will be deducted from any refund issued. CDs / DVDs which have been opened by you, cannot be returned. Magazines and other publications are exempt from this cooling-off period. Any refunds are issued at the discretion of the Company Management.

Faulty Items
If you find a CD / DVD to be faulty, you must inform us within 7 working days explaining exactly what the problem is. We advise that you check the item on at least 2 different machines, as we test every return and if it is found not to be faulty, we will send it back to you. If the item is indeed faulty, we can replace it with the same title or issue a refund if the item is not in stock and we are unable to procure it. Where a DVD manufacturer has used a secondary source (i.e. tape media) as opposed to the original film source to author a DVD, this will not be considered to be a faulty item and we will not accept returns for such items. This also applies where a CD manufacturer has used a secondary source as opposed to the original soundtrack. In such cases, we suggest that you raise the matter with the manufacturer. On some of the older recordings from the 1940s - 1960s, there may be some imperfections such as volume variation from song to song. We regret that we cannot accept returns for this reason.

The Format and Region of every DVD we sell is indicated under the product details of each title. Prior to purchasing a DVD, you must check that the DVD is compatible with your DVD Player as you will not be able to return it if you open it and find that it does not play on your System, as this is not classed as a faulty item.
